MINISTER OF TRADE: E-COMMERCE PLATFORMS ARE PROHIBITED FROM BEING PRODUCERS OF goods

Digital platforms that offer e-commerce or trading cannot manufacture goods. The permit to become a digital platform operator is different from the permit to create goods. The Minister of Trade (Mendag), Zulkifli Hasan, declared that digital platforms cannot be producers since their structures are different. Aligning with other rules set for August 1, 2023, Minister of Trade Regulation (Permendag) Number 50 of 2020 was revised. Social commerce is defined as electronic trading that requires a license, taxes, and permits for goods to enter. The rules may have an impact on MSMEs.The Indonesian National Standard (SNI) and the Food and Drug Supervisory Agency (BPOM) govern all goods sold through digital platforms that provide e-commerce. The price of imported goods sold on digital e-commerce platforms is still being contested by ministries/agencies. The amended Permendag No. 50/2020 will have an impact on all digital platforms in Indonesia that offer e-commerce when harmonization is complete by August 1. Nailul Huda, a researcher at the Center for Digital Economy and Small and Medium Enterprises at the Institute for Development of Economics and Finance (INDEF), believes that digital platforms that offer e-commerce can produce their own goods if they're made domestically.
